Terms of Service

These terms are an agreement between you and ElevationArk LLC (“SmrtSites”, “we”). By creating an account or using SmrtSites you agree to them. If you use SmrtSites for a business, you agree for that business.

1. Your account

You must be 16 or older to have a SmrtSites account. By creating an account (however you sign up) you confirm that you are at least 16.

You can sign in with a one-time code sent to your email, with an email and password, or with your Google account. Keep your inbox, password and those accounts safe — anyone who can get into them can get into SmrtSites.

One free trial per person. To keep free trials fair, we limit how many are given each day and from each internet connection; if a limit is reached, your account still opens and the free credits arrive when you sign in on a later day, once that day’s limit allows.

2. Credits and plans

• SmrtSites AI features cost credits; prices are shown before you spend anything. A generation is charged per design that actually comes out: a design that couldn’t be made (or only came out as a free starter layout) costs nothing, and failed builds and edits are refunded automatically. If you stop a generation yourself, you pay for the designs you keep.
• Trial credits expire 30 days after sign-up. Credits you buy in packs don’t expire.
• Plans ($39.99 / month or $399 / year) renew automatically until you cancel in Account → Billing. Monthly plan credits roll over up to the cap shown on the plan and expire 35 days after the period they were granted for.
• Credits have no cash value, can’t be transferred and aren’t refundable except as our Refund Policy says. Deleting your account forfeits any credits left on it.
• EU and UK customers: credits, downloads and other digital content are supplied straight away. By buying, you ask us to start right away and accept that you lose your 14-day right to withdraw once you start using them.

3. Your content

You own what you bring (text, logos, pictures, uploaded sites) and the sites SmrtSites makes for you. You give us permission to store, process and display that content only to run SmrtSites for you — including sending it to our AI provider to generate and edit your sites, and serving it when you publish or share it.

AI-written content can contain mistakes and may resemble other material. Check facts, claims, prices and legal text before you publish. You are responsible for what you publish.

4. Rules

Everything you create, upload, publish, share or sell must follow our Content Rules. We may remove content or suspend accounts that break them.

5. Publishing (SmrtSites Hosting)

Publishing unlocks with a site’s downloads. You can have up to 3 live sites (25 for subscribers); custom domains come with a subscription. We aim to keep sites online but don’t guarantee uptime. If you stop paying for a plan, sites beyond the free limit and custom domains may be switched off after notice.

6. Template marketplace

• Creators must own or have the rights to everything in a template they sell. Creators receive 80% of each sale; SmrtSites keeps 20% and pays card processing out of its share. Earnings become available 14 days after a sale; payouts start at $25.00 and are made through Stripe, to U.S. accounts only (you need a U.S. bank account and a U.S. tax ID).
• Buyers get a license to use a template for their own sites and for sites they make for clients. You may not resell or give away a template as a template.
• Licenses. A Personal license covers one site — yours or your own business. A Client & agency license covers as many sites as you like, including sites you build for and hand over to clients. Personal licenses can be upgraded by paying the difference. Either way, you may not resell or give away a template as a template.
• Creators may offer discount codes; the creator’s share is calculated on what the buyer actually paid.
• Buyers can get a refund within 7 days if they haven’t used or exported the template. Paid listings are reviewed before they go live, and we may remove any listing.

6a. Domains bought through SmrtSites

Domains are registered for you, in your name, through our registrar partner, with WHOIS privacy on; the registrar’s and the registry’s rules apply too. Prices include the registration and our service fee. Domains renew only when you pay for a renewal — we remind you before they expire; an expired domain may be lost. A domain that can’t be registered is refunded automatically. You can move your domain to another registrar after the first 60 days (a registry rule).

6b. Affiliate program

You can join the SmrtSites Affiliate Program from your account. Joining is optional and governed by the separate Affiliate Agreement, which you accept when you join.

6c. Blogs, analytics and SEO tools

You’re responsible for what you post on your blog. Add-ons bought for a site (blog, analytics, SEO setup) belong to that site and aren’t refundable once used. Analytics count visits without cookies; if you run a site, make sure your own privacy notice mentions that visits are counted.

6d. AI pictures, starting from a link, and invites

• AI pictures cost the credits shown and are made by OpenAI’s image models from your description. Don’t ask for real people, other people’s characters or brands, or anything our Content Rules forbid. You may use pictures you make on your sites; similar pictures can be made for others.
• Starting from a link: “Rebuild my site” is only for a site that’s yours or that you have permission to use. “Something like this site” takes only general ideas (layout, tone, colour mood) and never copies another site’s words, pictures, logos or branding — and you mustn’t add them yourself.
• Invites: a friend who joins with your invite link gets the bonus credits shown; you get the credits shown once they first buy credits or subscribe (up to 50 friends a year). Invite bonus credits expire 30 days after they’re given and have no cash value; self-invites and fake accounts don’t count and can close the account.

7. Ending things

You can stop using SmrtSites at any time and delete your account yourself (Account → Account → Delete account), or ask us to. We may suspend or close accounts that break these terms, don’t pay, or put others at risk; where we can, we’ll tell you first and let you download your sites.

8. Disclaimers and liability

SmrtSites is provided “as is”. To the extent the law allows, we disclaim implied warranties, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. We aren’t liable for indirect or consequential losses such as lost profits or data. Some places don’t allow these limits, so they may not apply to you.

9. Changes and law

We may update these terms; we’ll tell you about important changes by email or in the app before they take effect. These terms are governed by the laws of Colorado.
